Will I Be Subject to Carbon Tax?

What is a carbon tax? What is a carbon tariff?

A carbon tax is a fee on carbon dioxide emissions to encourage emission reduction by increasing costs. The EU began charging carbon fees in 2005, leading to unfair competition with foreign imports not subject to these fees.

To address this, the EU introduced the "Carbon Border Adjustment Mechanism" (CBAM), or "European carbon tariff," imposing fees on imported goods to ensure equal carbon costs. This impacts countries like Taiwan exporting to the EU.

The CBAM will trial from October 1, 2023, and fully implement in 2027. Importers must report product emissions and buy "CBAM certificates" for these costs. Initially, it covers steel, cement, aluminum, fertilizers, electricity, and will expand to hydrogen and related steel products.

What is a carbon footprint?

A carbon footprint refers to the total amount of greenhouse gas emissions produced by an individual, organization, or product. It is used to measure the contribution to climate change, typically expressed in terms of carbon dioxide equivalents. The carbon footprint includes both direct emissions (such as those from energy use and transportation) and indirect emissions (such as those from the production and transportation of goods). Understanding and reducing our carbon footprint can help mitigate the impact on climate change, promoting sustainable development and environmental protection.

Does Taiwan have a carbon market? How will it be calculated?

Taiwan does not have a carbon market like the EU. Instead, following the "Climate Change Response Act" passed on January 10, 2023, Taiwan will levy carbon taxes. These taxes will target major carbon emitters, specifically those emitting over 25,000 metric tons, including approximately 287 major emitters or 250 major electricity users. The Environmental Protection Administration plans to introduce carbon fees starting in 2024, along with 12 sub-laws to regulate carbon tax collection and management. Notably, nearly 40% of Taiwan's carbon emissions come from its top ten carbon-emitting companies, such as China Steel, Formosa Plastics, and TSMC.

If my business is not a major carbon emitter, does this exempt us from conducting a carbon inventory?

Certainly not.

Particularly for companies publicly listed in Taiwan, as part of the 1,700 publicly traded entities, compliance with the Financial Supervisory Commission's (FSC) regulations is mandatory. This includes conducting carbon inventories and disclosing carbon footprint along with other sustainability development data. On March 3, 2022, the FSC initiated a "Sustainable Development Roadmap for Listed Companies," mandating phased completion of carbon inventories according to the size of the listed companies.

Additionally, the FSC has announced that beginning in 2025, listed companies with revenues under NT$2 billion will be required to prepare sustainability reports. This requirement will affect approximately 1,267 companies, necessitating the compilation and submission of these reports. Furthermore, the FSC intends to broaden the scope of sustainability information disclosure, advocating for the disclosure of sustainability indicators by all listed companies.
